Terms of Service

The service
TeamDoctor provides electronic medical record and billing software to medical practices under a subscription and/or billing-service agreement. These terms govern staff use of the software; each practice's master agreement and Business Associate Agreement control where they differ. [COUNSEL: entity name, order-of-precedence clause.]
Accounts
Accounts are individual. Staff must keep credentials confidential, complete multi-factor authentication enrollment, and use the system only within their assigned role. Practices are responsible for promptly offboarding departed staff.
Acceptable use
- Access records only as needed for treatment, payment, or health-care operations
- No attempt to access another practice's data or bypass access controls
- No use of the service to store or transmit unlawful content
Clinical responsibility
TeamDoctor is documentation and billing software, not a medical device and not a source of medical advice. Licensed practitioners remain solely responsible for clinical decisions. [COUNSEL: disclaimer wording.]
Data
The practice owns its records. On termination, the practice may export its data; we retain audit trails and backups per the retention schedule in the master agreement. [COUNSEL: retention/return-of-PHI terms consistent with the BAA.]
